These General Terms and Conditions govern access to the website, browsing of the catalog and purchases made through www.ecartine.it.

Before placing an order, the Customer is invited to read these Terms carefully, together with the product information and the other legal pages referenced in the text.

2. Scope

These Terms and Conditions apply to:

  • access to and use of the Website;
  • browsing the catalog;
  • creation and management of an account;
  • submission, verification and acceptance of orders;
  • payments, shipping and delivery;
  • relationships with consumers and business customers;
  • warranties and after-sales services.

Mandatory provisions protecting the Consumer prevail over any incompatible clause in these Terms and Conditions.

3. Related contractual documents

The following form an integral part of the contractual relationship:

In the event of conflict, the following order of precedence applies:

  1. applicable mandatory provisions;
  2. specific terms accepted for the individual order;
  3. these Terms and Conditions;
  4. other general information published on the Website.

4. Definitions

Customer: any person who browses the Website, creates an account or submits an order.

Consumer: a natural person purchasing for purposes outside their trade, business, craft or profession.

Business Customer: a natural or legal person purchasing in the course of their business or professional activity.

Product: any item listed in the catalog and available for the Customer and selected destination.

5. Age requirement

As a matter of commercial policy and for the protection of minors, purchases through the Site are reserved for persons who are at least eighteen years old and have the legal capacity required to enter into a contract.

By placing an order, the Customer declares that:

  • are of legal age;
  • have the necessary contractual capacity;
  • provide genuine, complete and up-to-date information;
  • use a payment method they are authorized to use;
  • purchase and use the products exclusively for lawful purposes.

The Seller may carry out proportionate checks where necessary to protect minors, prevent fraud or comply with legal obligations.

6. Products sold

The Website mainly sells:

  • rolling papers;
  • filters;
  • tips;
  • cigarette tubes;
  • rolling accessories;
  • other accessories actually listed in the catalog.

Unless expressly stated otherwise and accompanied by any required authorization, the Seller does not sell:

  • manufactured tobacco;
  • narcotic substances;
  • illegal substances;
  • medicinal products;
  • products to which unauthorized therapeutic properties are attributed.

Images, descriptions and other Website content do not constitute an incentive to consume tobacco, use prohibited substances or engage in unlawful conduct.

7. Access from Italy and product availability

Users located in Italy may access the Site, browse the catalogue, create an account, request assistance, place orders and contact the Seller for commercial enquiries or professional cooperation.

The Seller does not apply a general exclusion solely on the basis of Italian citizenship, residence in Italy, an Italian IP address or the use of the Italian language.

The actual availability of each product may nevertheless depend on:

  • stock availability;
  • shipping destination;
  • the actual features and classification of the product;
  • the Customer's status;
  • the sales or distribution channel;
  • the terms of the carrier and payment service provider;
  • tax, administrative, commercial and safety obligations applicable to the individual transaction.

The presence of a product in the catalogue or the technical possibility of adding it to the cart does not constitute final acceptance of the order.

If an order cannot be fulfilled, in whole or in part, the Seller informs the Customer and proceeds with the agreed amendment, cancellation or full refund of the items not shipped.

8. Business customers and B2B relationships

Retailers, distributors and other economic operators, including those established in Italy, may contact the Seller to request:

  • commercial information;
  • quotations;
  • business price lists;
  • wholesale supplies;
  • commercial cooperation;
  • customized B2B terms.

To verify business status, the Seller may request:

  • company name;
  • VAT number;
  • registered business address;
  • registration number;
  • description of the business activity;
  • any required authorization or documents;
  • the intended commercial destination of the products.

Merely providing a VAT number or selecting the “company” option does not result in automatic acceptance of a business supply arrangement.

9. Product information and images

The Seller undertakes to present the essential characteristics of the products clearly.

Before placing the order, the Customer must check:

  • size and dimensions;
  • quantity and package contents;
  • material and stated features;
  • compatibility with the intended use;
  • product code or model;
  • any instructions and warnings.

Images are for illustrative purposes. Non-material differences in graphics, color, labels or packaging caused by manufacturer updates do not constitute a defect where they do not change the product's identity, quantity, function or essential quality.

10. Safety, authenticity and traceability

The Seller may suspend or remove a product where:

  • mandatory information is unavailable;
  • there are reasonable doubts about origin or authenticity;
  • required warnings or traceability information are missing;
  • the product is subject to a recall or official measure;
  • information arises that requires further checks.

The Customer must not remove or alter labels, batch codes, warnings or other identifying elements before inspecting the product.

11. Prices, VAT and charges

  • the product price;
  • any discounts;
  • applicable taxes;
  • shipping charges;
  • any additional charges;
  • the total amount payable.

The Customer is not required to pay charges that were not clearly disclosed before the order.

12. Promotions and discount codes

Le promozioni e i codici sconto si applicano secondo le condizioni specificamente indicate nel Sito.

Salvo diversa indicazione, le promozioni:

  • cannot be exchanged for cash;
  • may apply only to certain products or destinations;
  • may require a minimum order value;
  • cannot be combined;
  • may not be used fraudulently or through automated means.

13. Ordering procedure

Before submitting an order, the Customer may:

  • check products and quantities;
  • edit the cart;
  • correct billing and delivery details;
  • check prices, taxes and charges;
  • review these Terms and Conditions;
  • review information about the right of withdrawal;
  • check the total amount payable.

The final checkout button clearly indicates that placing the order entails an obligation to pay.

The Customer is responsible for the accuracy of the information provided.

14. Submission and acceptance of the order

The order placed by the Customer constitutes an offer to purchase.

The automatic acknowledgement email confirms that the system has received the order, but does not necessarily constitute final acceptance.

  • notifies the Customer that the order has been shipped.

Before acceptance or shipment, the Seller may verify:

  • stock availability;
  • payment validity;
  • the address and destination;
  • product characteristics;
  • any declared professional status;
  • anomalies or objective indicators of fraud.

15. Availability and obvious errors

Availability may vary due to simultaneous orders, inventory errors, damaged stock, supplier delays, suspensions or product recalls.

If a product is unavailable, the Seller informs the Customer and may:

  • wait for restocking with the Customer's consent;
  • offer an alternative product, without automatic substitution;
  • cancel the unavailable product;
  • refund the corresponding amount;
  • ship the other ordered products separately.

A clearly recognizable clerical or technical error in the price, quantity or description may be corrected before final acceptance of the order.

The Customer is informed and may confirm the corrected order or receive a refund of any amounts already paid for the product that was not accepted.

16. Payment methods

  • payment is not authorized or received;
  • required authentication is not completed;
  • the payment service provider identifies a specific risk;
  • inconsistent information or objective indicators of fraud arise.

Full card details are normally processed directly by the payment service provider and are not retained by the Seller.

17. Shipping and delivery

Available destinations, carriers, methods, costs and estimated shipping times are published on the Shipping and Payments e mostrati nel checkout.

Unless otherwise agreed, delivery to the Consumer takes place without undue delay and in any event within thirty days of the conclusion of the contract.

The Customer must provide a complete, correct and valid address that is accessible to the courier.

18. Transfer of risk

In consumer transactions, the risk of loss or damage passes to the Consumer when the Consumer, or a third party designated by the Consumer other than the courier, takes physical possession of the products.

When the Consumer independently appoints a courier not offered by the Seller, the risk passes when the goods are handed over to the courier chosen by the Consumer, without prejudice to any rights against the carrier.

19. Inspection of the shipment

On delivery, the Customer is invited to check:

  • the integrity of the packaging;
  • the number of parcels;
  • any signs of opening;
  • any visible damage;
  • that the shipment corresponds to the order.

In presenza di danni visibili è opportuno formulare una riserva specifica al corriere, fotografare il pacco e conservare l’imballaggio.

Failure to make a reservation with the courier does not automatically remove the Consumer’s mandatory rights.

20. Failure to collect and incorrect address

When a shipment is returned because of an incorrect address, unknown recipient, repeated absence, failure to collect or unjustified refusal, the Seller contacts the Customer.

To the extent permitted by law, only actual, documented costs directly caused by the failed delivery attributable to the Customer may be charged or deducted.

Failure to collect the parcel does not automatically constitute a valid declaration of withdrawal.

21. Right of withdrawal, returns and refunds

Subject to the exceptions provided by law, the Consumer has fourteen days to communicate the decision to withdraw from the contract without having to provide a reason.

Nothing in these Terms and Conditions limits the Consumer's mandatory rights.

22. Statutory guarantee of conformity

Products purchased by consumers are covered by the statutory guarantee of conformity provided by applicable law.

For new goods, the statutory guarantee applies for at least two years from delivery, without prejudice to any more favourable rights or periods provided by applicable law.

Where the legal requirements are met, the Consumer may be entitled to:

  • repair;
  • replacement;
  • a proportionate price reduction;
  • termination of the contract and a refund.

The guarantee does not cover issues caused solely by normal wear and tear, misuse, improper storage, modification of the product or use contrary to instructions.

23. Defective, damaged or incorrect products

The Customer must contact the Seller if they receive:

  • a product different from the one ordered;
  • an incorrect quantity;
  • a damaged product;
  • a product that appears defective;
  • a parcel missing one or more items.

The communication should include the order number, a description of the problem and, where useful, photographs of the product, packaging and shipping label.

The request for photographs is intended to facilitate verification and does not remove the Consumer’s rights.

24. Liability

The Seller is responsible for performance of the contract and for the obligations imposed directly on it by law.

  • fraud, willful misconduct or gross negligence;
  • personal injury;
  • lack of conformity;
  • breach of mandatory obligations;
  • rights that cannot be excluded or limited by law.

The Seller is not liable for damage arising solely from unlawful use or use that is clearly contrary to instructions, false information provided by the Customer or events outside the Seller's reasonable control, without prejudice to the Consumer's mandatory rights.

25. Force majeure

Delays or impediments caused by natural disasters, fires, wars, general strikes, measures by public authorities, transport disruptions, exceptional system unavailability or other events beyond the Seller’s reasonable control do not automatically constitute a breach of contract.

The Seller informs the Customer and takes reasonable measures to limit the consequences.

When performance becomes permanently impossible, the amounts relating to products not supplied are refunded.

26. Account and proper use of the Website

The Customer is responsible for keeping account credentials confidential and must promptly report any unauthorized access.

  • manipulation of checkout;
  • abusive automated ordering;
  • other unlawful activities.

The Seller may suspend an account when necessary to protect the Site, Customers or payment systems.

Suspension of the account does not remove rights relating to orders that have already been validly concluded.

27. Reviews and user content

Le recensioni devono riferirsi a esperienze autentiche.

Non sono ammessi contenuti:

  • false or misleading content;
  • defamatory or threatening content;
  • discriminatory content;
  • promotional or automated content;
  • content containing third-party personal data;
  • content relating to unlawful uses;
  • content infringing the rights of others.

A review may be removed on the basis of its content, not merely because it expresses a negative opinion.

28. Intellectual property

The original texts, photographs, graphics, descriptions, structure, logos and database of the Site are protected by applicable law and belong to the Seller or their respective owners.

Reproduction or commercial use of the content without authorization is prohibited, except for uses expressly permitted by law.

29. Privacy and cookies

30. Complaints and support

For support or complaints, the Customer may write to:

The communication should state:

  • the Customer's name;
  • the order number, where applicable;
  • the product concerned;
  • a description of the issue;
  • the requested solution;
  • any available supporting documents.

31. Alternative dispute resolution

The Consumer retains the right to refer disputes to alternative dispute resolution bodies recognized under applicable law and to the competent European Consumer Centre for cross-border disputes.

The former European online dispute resolution platform, known as the ODR platform, has no longer been operational since 20 July 2025 and is not presented as an available tool.

32. Governing law and jurisdiction

These Terms and the contracts concluded through the Site are governed by Greek law.

The choice of Greek law does not deprive the Consumer of the mandatory protections granted by the law of the country in which the Consumer has their habitual residence, where those protections apply.

Disputes involving a Consumer fall within the jurisdiction of the court determined by the applicable mandatory rules, including the court of the Consumer’s place of residence or domicile where provided by law.

For disputes between the Seller and a professional Customer, unless otherwise agreed in writing or required by mandatory law, jurisdiction lies with the court of the place where the Seller is established.

33. Changes to the Terms and Conditions

The Seller may update these Terms in the event of regulatory, operational, technical or commercial changes.

The changes apply to orders placed after the new version has been published.

34. Severability and no waiver

Qualora una clausola risulti nulla, inefficace o inapplicabile, le restanti disposizioni continuano a produrre effetto.
